Os advogados de Castro dizem que o delegado do caso descumpriu uma instru\u00e7\u00e3o normativa da pr\u00f3pria PF, que prev\u00ea que investigados s\u00f3 podem ser indiciados ap\u00f3s terem a chance de ser interrogados, e tratam a condu\u00e7\u00e3o da investiga\u00e7\u00e3o como \u201carbitr\u00e1ria e ilegal\u201d.<\/p>\n<p>Os advogados do governador pedem que Castro seja ouvido pela PF, a substitui\u00e7\u00e3o da autoridade policial que esteve \u00e0 frente do inqu\u00e9rito e a apura\u00e7\u00e3o do vazamento de informa\u00e7\u00f5es sobre o indiciamento. Para a defesa do mandat\u00e1rio, a conduta do delegado da PF configura abuso de autoridade e \u201cescancara o vi\u00e9s arbitr\u00e1rio e pol\u00edtico do rumo das investiga\u00e7\u00f5es\u201d.<\/p>\n<blockquote>\n<p>\u201cNa manh\u00e3 de ter\u00e7a-feira, despertamos com not\u00edcias na m\u00eddia escrita e falada dando conta do encerramento das investiga\u00e7\u00f5es do presente inqu\u00e9rito policial, bem como do indiciamento do ora requerente, evidenciando novo e lament\u00e1vel epis\u00f3dio de vazamento do procedimento sigiloso. Causou estranheza o fato de que em momento algum, enquanto advogados devidamente constitu\u00eddos, tiv\u00e9ssemos conhecimento do encerramento das investiga\u00e7\u00f5es e do indiciamento (arbitr\u00e1rio) do peticion\u00e1rio, governador de Estado, ainda que as mat\u00e9rias jornal\u00edsticas mencionem que isso ocorreu h\u00e1 cerca de um m\u00eas\u201d, argumenta trecho da peti\u00e7\u00e3o protocolada no STJ.<\/p>\n<\/blockquote>\n<p>A defesa alega que a instru\u00e7\u00e3o Normativa n\u00ba 255\/2023-DG\/PF, de 20 de julho de 2023, que regulamenta a atividade de pol\u00edcia judici\u00e1ria da Pol\u00edcia Federal, determina que o delegado s\u00f3 poder\u00e1 propor um indiciamento indireto quando n\u00e3o for poss\u00edvel interrogar o investigado, o que, segundo a defesa, n\u00e3o \u00e9 o caso do governador.<\/p>\n<p>Os advogados citam o artigo 6\u00ba, inciso V, do C\u00f3digo de Processo Penal, que prev\u00ea a exig\u00eancia de oitiva dos investigados, e recorrem a uma jurisdi\u00e7\u00e3o do Supremo Tribunal Federal (STF), que, por meio do ministro Celso de Mello, entendeu, em manifesta\u00e7\u00e3o anterior, \u201cque o investigado n\u00e3o pode ser tratado como mero objeto dentro das investiga\u00e7\u00f5es\u201d. O Estad\u00e3o procurou a Pol\u00edcia Federal, que ainda n\u00e3o se manifestou sobre o pedido dos advogados.<\/p>\n<p>\u201cAgir assim, de forma ilegal, caracteriza excesso e qui\u00e7\u00e1, permissa v\u00eania, abuso de autoridade, o qual merece an\u00e1lise e apura\u00e7\u00e3o; parece-nos de uma obviedade absoluta que ao investigado seja dada a oportunidade de ser interrogado para assim esclarecer os fatos e apresentar provas da sua inoc\u00eancia\u201d, dizem.<\/p>\n<p>A defesa de Cl\u00e1udio Castro tamb\u00e9m pleiteia que seja disponibilizada c\u00f3pia do relat\u00f3rio final da Pol\u00edcia Federal, assim como o acesso aos autos. O caso tramita em sigilo no STJ e o relator \u00e9 o ministro Raul Ara\u00fajo. O pedido de cancelamento do relat\u00f3rio \u00e9 assinado pelos advogados Daniel Leon Bialski, Bruno Garcia Borragine, Lu\u00eds Felipe D\u2019Al\u00f3ia, Bruna Luppi Moraes e Andr\u00e9 Mendon\u00e7a Bialski.<\/p>\n<p>A PF pediu ao STJ o indiciamento e afastamento de Castro. A solicita\u00e7\u00e3o consta no relat\u00f3rio em que a corpora\u00e7\u00e3o atribuiu ao mandat\u00e1rio supostos crimes de corrup\u00e7\u00e3o passiva e peculato na esteira das Opera\u00e7\u00f5es e S\u00e9timo Mandamento. A PF indiciou o governador por suposto envolvimento com um esquema de desvios milion\u00e1rios entre 2017 e 2020, quando ele era vereador e vice-governador (gest\u00e3o Wilson Witzel).<\/p>\n<p>O documento apresentado ao gabinete do ministro Raul Ara\u00fajo, relator da investiga\u00e7\u00e3o no Superior Tribunal de Justi\u00e7a, agora deve ser remetido \u00e0 Procuradoria-Geral da Rep\u00fablica (PGR). Cabe ao \u00f3rg\u00e3o avaliar os achados da PF e decidir se denuncia ou n\u00e3o Castro. A PGR tamb\u00e9m deve dar um parecer sobre o pedido de afastamento do governador.<\/p>\n<p>Cl\u00e1udio Castro virou alvo do inqu\u00e9rito agora finalizado pela PF em abril de 2023. A investiga\u00e7\u00e3o versa sobre supostos crimes de organiza\u00e7\u00e3o criminosa, fraude em licita\u00e7\u00f5es, corrup\u00e7\u00e3o ativa e passiva, lavagem de dinheiro e peculato que teriam
