O Tribunal Regional Eleitoral de S\u00e3o Paulo (TRE-SP)<\/strong> decidiu nesta ter\u00e7a-feira (3), por unanimidade, manter a condena\u00e7\u00e3o<\/strong> do presidente Luiz In\u00e1cio Lula<\/strong> da Silva (PT) e do candidato \u00e0 prefeitura de S\u00e3o Paulo, Guilherme Boulos<\/strong> (PSOL), por propaganda eleitoral antecipada<\/strong> .<\/p>\n

Lula e Boulos foram condenados pelo pedido expl\u00edcito de voto ao candidato feito pelo presidente durante as celebra\u00e7\u00f5es do Dia do Trabalhador em S\u00e3o Paulo.<\/p>\n

Apesar de manterem a condena\u00e7\u00e3o, os desembargadores do TRE-SP decidiram reduzir o valor das multas <\/strong> atribu\u00eddas aos aliados<\/span> : a de Lula foi de R$ 20 mil para R$ 15 mil e de Boulos, de R$ 15 mil para R$ 10 mil.<\/p>\n

O pedido de voto feito por Lula foi alvo de a\u00e7\u00f5es na Justi\u00e7a Eleitoral apresentadas pelo MDB, do prefeito Ricardo Nunes; pelo Partido Novo, da candidata Marina Helena; e pelo diret\u00f3rio nacional do PP \u2014 este \u00faltimo negado pelo TRE-SP, que considerou que n\u00e3o cabe ao \u00f3rg\u00e3o acionar um tribunal regional.<\/p>\n

Durante as celebra\u00e7\u00f5es do Primeiro de Maio em Itaquera, na Zona Leste, Lula disse ao p\u00fablico convocado pelas centrais sindicais:<\/p>\n

“Ningu\u00e9m derrotar\u00e1 esse mo\u00e7o aqui se voc\u00eas votarem no Boulos para prefeito de S\u00e3o Paulo nas pr\u00f3ximas elei\u00e7\u00f5es. E eu vou fazer um apelo: cada pessoa que votou no Lula em 89, em 94, em 98, em 2006, em 2010, em 2018, em 2022, tem que votar no Boulos para prefeito de S\u00e3o Paulo”, disse o petista.<\/p>\n

A defesa de Lula afirma que o presidente fez “mera men\u00e7\u00e3o \u00e0 pr\u00e9-candidatura” de Boulos e alegaram “inexistir expressiva lesividade” em sua conduta. Os advogados de Boulos citaram o princ\u00edpio da liberdade de express\u00e3o, e adicionaram que o candidato n\u00e3o tinha conhecimento pr\u00e9vio do discurso do presidente.<\/p>\n

Em seu voto, o relator Encinas Manfr\u00e9 defendeu o direito constitucional da livre manifesta\u00e7\u00e3o do pensamento, mas ponderou que “n\u00e3o se pode admitir que, sob essa fundamental garantia, se possa afrontar limites estabelecidos na legisla\u00e7\u00e3o eleitoral”.<\/p>\n

“Dada a realiza\u00e7\u00e3o desse evento faltando poucos meses para as elei\u00e7\u00f5es, e com express\u00f5es pass\u00edveis de influenciar na disputa eleitoral, essa pr\u00e1tica, conforme assinalado, \u00e9 incompat\u00edvel ao princ\u00edpio da igualdade de oportunidades no pleito eleitoral”, escreveu.<\/p>\n
