A decis\u00e3o decorre de A\u00e7\u00e3o Civil P\u00fablica proposta pelo Minist\u00e9rio P\u00fablico do Distrito Federal e Territ\u00f3rios (MPDFT) e visa restaurar a ordem urban\u00edstica e recompor os danos causados ao meio ambiente.<\/p>\n<p>No processo, o MPDFT afirmou que<b>\u00a0<\/b>o<b>\u00a0parcelamento do solo ocorreu sem licen\u00e7as pr\u00e9vias, em regi\u00e3o sens\u00edvel, onde a legisla\u00e7\u00e3o ambiental exige cuidados espec\u00edficos<\/b>. A acusa\u00e7\u00e3o destacou que a ocupa\u00e7\u00e3o clandestina aumentava a degrada\u00e7\u00e3o ambiental e colocava em risco recursos h\u00eddricos, flora, fauna e seguran\u00e7a dos moradores. O Distrito Federal, a Ag\u00eancia de Fiscaliza\u00e7\u00e3o do Distrito Federal (AGEFIS) e a Companhia Imobili\u00e1ria de Bras\u00edlia (Terracap) foram apontados como correspons\u00e1veis, em raz\u00e3o de omiss\u00f5es na fiscaliza\u00e7\u00e3o e na prote\u00e7\u00e3o da \u00e1rea.<\/p>\n<p>Ao analisar o caso, o Juiz ressaltou que o assentamento foi\u00a0<b>\u201cinequivocamente il\u00edcito e denotativo de profundo dano urban\u00edstico<\/b>\u201d. A senten\u00e7a enfatizou que a responsabilidade ambiental \u00e9 ampla e solid\u00e1ria, o que engloba tanto quem ocupa e constr\u00f3i de forma irregular quanto os entes p\u00fablicos respons\u00e1veis por impedir a continuidade das viola\u00e7\u00f5es. Ainda segundo a decis\u00e3o, a mera expectativa de futura regulariza\u00e7\u00e3o n\u00e3o pode afastar a obriga\u00e7\u00e3o de cumprir as normas ambientais, pois n\u00e3o h\u00e1 direito autom\u00e1tico \u00e0 transforma\u00e7\u00e3o de \u00e1reas protegidas em n\u00facleos urbanos.<\/p>\n<p>Como resultado, a<b>\u00a0Justi\u00e7a manteve a ordem para demolir edifica\u00e7\u00f5es sem permiss\u00e3o e recompor o solo ao estado natural<\/b>, conforme plano de recupera\u00e7\u00e3o da \u00e1rea degradada a ser custeado pelos r\u00e9us,\u00a0<a href=\"https:\/\/www.tjdft.jus.br\/institucional\/imprensa\/campanhas-e-produtos\/direito-facil\/edicao-semanal\/responsabilidade-solidaria-x-responsabilidade-subsidiaria\">solidariamente<\/a>, no<b>\u00a0<\/b>prazo de 12 meses, sob pena de multa no valor de R$ 10 mil por dia de atraso, at\u00e9 o limite de R$ 500 milh\u00f5es.<\/p>\n<p>Os r\u00e9us dever\u00e3o ainda<b>\u00a0indenizar eventuais danos irrecuper\u00e1veis<\/b>. Al\u00e9m disso, est\u00e3o\u00a0<strong>proibidos de realizar qualquer obra ou atividade que amplie o parcelamento ilegal<\/strong>, sob pena de multa\u00a0no valor de R$ 100 mil por dia, at\u00e9 a cessa\u00e7\u00e3o da eventual conduta proibida.<\/p>\n<p>Por fim, o magistrado determinou que o\u00a0<strong>poder p\u00fablico reforce a fiscaliza\u00e7\u00e3o para impedir novas
