Regional do Trabalho da Segunda Regi\u00e3o <strong>extinguiu a\u00e7\u00e3o civil p\u00fablica em que a Uber havia sido condenada em 1\u00ba grau a reconhecer v\u00ednculo empregat\u00edcio de motoristas cadastrados na plataforma, al\u00e9m de pagar multa de R$ 1 bilh\u00e3o por danos morais coletivos.<\/strong><img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.png?id=1632049&amp;o=node\" \/><img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.gif?id=1632049&amp;o=node\" \/><\/p>\n<p>Os magistrados n\u00e3o julgaram o m\u00e9rito da a\u00e7\u00e3o e a\u00a0<strong>extinguiram por entenderem que o autor da a\u00e7\u00e3o, o Minist\u00e9rio P\u00fablico do Trabalho (MPT), n\u00e3o \u00e9 a entidade leg\u00edtima para defender os direitos individuais dos trabalhadores.<\/strong>\u00a0Para a Turma, o v\u00ednculo empregat\u00edcio dever\u00e1 ser provado por a\u00e7\u00f5es pr\u00f3prias individuais de cada trabalhador.<\/p>\n<p>O Minist\u00e9rio P\u00fablico do Trabalho poder\u00e1 recorrer ao Tribunal Superior do Trabalho (TST).<\/p>\n<p>Em nota, a Uber disse que a posi\u00e7\u00e3o dominante da Justi\u00e7a tem sido de apontar a aus\u00eancia dos requisitos legais para caracteriza\u00e7\u00e3o de v\u00ednculo empregat\u00edcio. \u201cAo extinguir a a\u00e7\u00e3o, a decis\u00e3o da 13\u00aa Turma reestabelece a justi\u00e7a, pois o julgamento de primeiro grau contrariava a posi\u00e7\u00e3o dominante da
