Ele foi atingido por policiais enquanto fazia a cobertura jornal\u00edstica do protesto.<\/p>\n<p>O caso chegou ao Supremo por meio de um recurso protocolado pela defesa de S\u00e9rgio Silva para derrubar as decis\u00f5es de primeira e segunda inst\u00e2ncias da Justi\u00e7a de S\u00e3o Paulo, que rejeitaram o pedido de indeniza\u00e7\u00e3o.<\/p>\n<p><strong>Por unanimidade, os ministros entenderam que a responsabilidade do estado deve ser reconhecida, ainda que a per\u00edcia do caso n\u00e3o tenha conclu\u00eddo que a les\u00e3o do fot\u00f3grafo ocorreu por disparo de bala de borracha.<\/strong><\/p>\n<p>Durante o julgamento, a ministra C\u00e1rmen L\u00facia afirmou que a per\u00edcia inconclusiva n\u00e3o exime o Estado de suas responsabilidades.<\/p>\n<blockquote><p>&#8220;Ele estava trabalhando, estava ali cumprindo a fun\u00e7\u00e3o dele.
