{"id":158885,"date":"2026-10-06T17:45:00","date_gmt":"2026-10-06T20:45:00","guid":{"rendered":"https:\/\/www.fatosefotosnews.com.br\/?p=158885"},"modified":"2026-10-06T17:45:00","modified_gmt":"2026-10-06T20:45:00","slug":"agu-pede-a-fux-que-aguarde-pgr-e-mantenha-proibicao-das-bets-no-pais","status":"publish","type":"post","link":"https:\/\/www.fatosefotosnews.com.br\/?p=158885","title":{"rendered":"AGU pede a Fux que aguarde PGR e mantenha proibi\u00e7\u00e3o das bets no pa\u00eds"},"content":{"rendered":"<p>Foto:Rafa Neddermeyer\/Ag\u00eancia Brasil<\/p>\n<div class=\"conteudo-noticia\">\n<p>A Advocacia-Geral da Uni\u00e3o (AGU) pediu ao Supremo Tribunal Federal (STF) que mantenha em vigor a <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/_ato2023-2026\/2026\/mpv\/mpv1394.htm\" target=\"_blank\" rel=\"noopener\">medida provis\u00f3ria (MP)<\/a>\u00a0que <a href=\"https:\/\/agenciabrasil.ebc.com.br\/economia\/noticia\/2026-09\/mp-proibe-bets-no-brasil-e-determina-devolucao-de-saldo-ao-apostador\" target=\"_blank\" rel=\"noopener\">proibiu a atividade das bets no pa\u00eds<\/a>.<img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.png?id=1704524&amp;o=node\" \/><img decoding=\"async\" src=\"https:\/\/agenciabrasil.ebc.com.br\/ebc.gif?id=1704524&amp;o=node\" \/><\/p>\n<p>No parecer, o advogado-geral da Uni\u00e3o, Jorge Messias, pede ainda que o ministro Luiz Fux, relator do tema no STF, <strong>aguarde a manifesta\u00e7\u00e3o da Procuradoria-Geral da Rep\u00fablica (PGR) antes de decidir sobre o pedido<\/strong> para que os efeitos da MP sejam suspensos.<\/p>\n<p>A AGU requereu tamb\u00e9m que, antes de decidir, Fux realize uma nova audi\u00eancia p\u00fablica sobre o assunto, nos moldes de uma primeira realizada em novembro de 2024.<\/p>\n<p>A <a href=\"https:\/\/agenciabrasil.ebc.com.br\/justica\/noticia\/2026-09\/associacoes-de-jogos-acionam-stf-contra-mp-que-proibiu-apostas-online\" target=\"_blank\" rel=\"noopener\">suspens\u00e3o da proibi\u00e7\u00e3o das bets <\/a>foi pedida em 28 de setembro pela Associa\u00e7\u00e3o Nacional de Jogos e Loterias (ANJL) e pelo Instituto Brasileiro de Jogo Respons\u00e1vel (IBJR). <strong>As entidades argumentam que a medida foi abrupta, provocando preju\u00edzos bilion\u00e1rios para as empresas que acreditaram no marco regulat\u00f3rio vigente no pa\u00eds e fizeram investimentos.<\/strong><\/p>\n<p>As associa\u00e7\u00f5es do setor insistiram para que a liminar fosse concedida antes das manifesta\u00e7\u00f5es da AGU e da PGR e at\u00e9 as 23h59 desta segunda-feira (5),<a href=\"https:\/\/agenciabrasil.ebc.com.br\/geral\/noticia\/2026-10\/bets-comecam-sair-do-ar-nesta-terca-feira\" target=\"_blank\" rel=\"noopener\"> prazo final para que os portais e plataformas das bets saiam do ar<\/a>.<\/p>\n<p>Fux, contudo, resolveu aguardar a manifesta\u00e7\u00e3o da AGU antes de qualquer decis\u00e3o sobre o tema. O ministro \u00e9 relator de tr\u00eas a\u00e7\u00f5es diretas de inconstitucionalidade que questionam o marco legal das bets, que entrou em vigor em 2023 e acabou extinto pela medida provis\u00f3ria.<\/p>\n<p>Assinada em 25 de setembro pelo presidente Luiz In\u00e1cio Lula da Silva, a MP questionada proibiu em todo territ\u00f3rio nacional a explora\u00e7\u00e3o, a oferta, a intermedia\u00e7\u00e3o e a publicidade de apostas de quotas fixas, as chamadas bets.<\/p>\n<h2>Manifesta\u00e7\u00e3o<\/h2>\n<p>A <a href=\"https:\/\/agenciabrasil.ebc.com.br\/justica\/noticia\/2026-10\/agu-pede-ao-stf-que-declare-inconstitucionais-leis-das-bets\" target=\"_blank\" rel=\"noopener\">AGU j\u00e1 havia se manifestado pela inconstitucionalidade da Lei das Bets<\/a>,\u00a0 que fora proposta e sancionada pelo pr\u00f3prio governo. Agora, ao pedir para que a MP que proibiu as bets seja mantida pelo STF, o advogado-geral da Uni\u00e3o insistiu que a experi\u00eancia de regula\u00e7\u00e3o n\u00e3o foi o bastante para proteger a popula\u00e7\u00e3o dos malef\u00edcios das apostas online.<\/p>\n<p>\u201cA explora\u00e7\u00e3o das apostas de quota fixa vinha sendo acompanhada por diversos \u00f3rg\u00e3os p\u00fablicos, que identificaram indicativos de repercuss\u00f5es relevantes sobre o or\u00e7amento familiar, o endividamento, a sa\u00fade, a prote\u00e7\u00e3o de pessoas em situa\u00e7\u00e3o de vulnerabilidade e outros interesses constitucionalmente protegidos\u201d, escreveu Jorge Messias.<\/p>\n<p>Para justificar a urg\u00eancia da edi\u00e7\u00e3o de uma medida provis\u00f3ria proibindo as bets de imediato no pa\u00eds, o <a href=\"https:\/\/agenciabrasil.ebc.com.br\/politica\/noticia\/2026-09\/saiba-como-bets-adoeceram-e-endividaram-os-brasileiros\" target=\"_blank\" rel=\"noopener\"><strong>AGU voltou a citar diversos malef\u00edcios \u00e0 popula\u00e7\u00e3o<\/strong><\/a>, como o endividamento das fam\u00edlias, a desprote\u00e7\u00e3o de crian\u00e7as e adolescentes, os impactos na economia formal e o aumento de 140% nos atendimentos do Sistema \u00danico de Sa\u00fade (SUS) a pessoas com transtornos provocados pelo v\u00edcio em jogos.<\/p>\n<p>O AGU tamb\u00e9m afastou argumentos de que o governo n\u00e3o poderia ter renunciado \u00e0 arrecada\u00e7\u00e3o prevista com os impostos pagos pelas bets.
