A decis\u00e3o do STF, tomada em 2012, permite a abertura de a\u00e7\u00e3o penal incondicionada nesses casos<\/strong><\/h3>\n\n\n\n
No mesmo dia em que confirmou a validade da Lei Maria da Penha (Lei 11.340\/2006), o Plen\u00e1rio do Supremo Tribunal Federal (STF) decidiu tamb\u00e9m que o Minist\u00e9rio P\u00fablico (MP) pode propor a\u00e7\u00e3o penal em caso de viol\u00eancia dom\u00e9stica contra a mulher, mesmo de car\u00e1ter leve, sem necessidade de representa\u00e7\u00e3o da v\u00edtima. Esse julgamento hist\u00f3rico foi realizado no dia 9 de fevereiro de 2012, na A\u00e7\u00e3o Direta de Inconstitucionalidade (ADI) 4424.<\/p>\n\n\n\n
A a\u00e7\u00e3o foi ajuizada pela Procuradoria-Geral da Rep\u00fablica (PGR) para questionar dispositivo da Lei Maria da Penha que condicionava a representa\u00e7\u00e3o contra o agressor \u00e0 concord\u00e2ncia da v\u00edtima. Por 10 votos a 1, vencido o ent\u00e3o presidente da Corte, ministro Cezar Peluso (aposentado), o colegiado adequou a interpreta\u00e7\u00e3o do artigo 16 da lei para que a abertura da a\u00e7\u00e3o penal p\u00fablica n\u00e3o seja mais condicionada \u00e0 representa\u00e7\u00e3o da agredida. No entendimento da maioria, essa imposi\u00e7\u00e3o esvaziava a prote\u00e7\u00e3o constitucional \u00e0s mulheres buscada pela lei.<\/p>\n\n\n\n
Reitera\u00e7\u00e3o da viol\u00eancia<\/strong><\/h5>\n\n\n\n
No voto que conduziu o julgamento, o ministro Marco Aur\u00e9lio (aposentado) destacou a import\u00e2ncia de que a representa\u00e7\u00e3o pudesse ser feita por terceiros. Ele apresentou dados estat\u00edsticos que demonstravam que, em 90% dos casos, a mulher agredida acabava retirando a queixa e renunciando \u00e0 representa\u00e7\u00e3o. Na sua avalia\u00e7\u00e3o, isso contribu\u00eda para a reitera\u00e7\u00e3o da viol\u00eancia de forma cada vez mais agressiva.<\/p>\n\n\n\n
Medo de repres\u00e1lias<\/strong><\/h5>\n\n\n\n
A maioria do colegiado acompanhou o argumento de que est\u00e1 fora da realidade deixar a crit\u00e9rio da v\u00edtima, da mulher, decidir se o processo contra o agressor deve ou n\u00e3o seguir, uma vez que a manifesta\u00e7\u00e3o da sua vontade \u00e9 cerceada pela pr\u00f3pria viol\u00eancia, por medo de repres\u00e1lias e de mais agress\u00e3o.<\/p>\n\n\n\n
Ao acompanhar o relator, o ministro Ricardo Lewandowski sintetizou o sentimento do colegiado ao destacar que as mulheres n\u00e3o representam criminalmente contra o companheiro ou marido em raz\u00e3o \u201cda permanente coa\u00e7\u00e3o moral e f\u00edsica que sofrem e que inibe a sua livre manifesta\u00e7\u00e3o da vontade\u201d.<\/p>\n\n\n\n

A s\u00e9rie de mat\u00e9rias “O STF e os direitos das mulheres” est\u00e1 alinhada com o Objetivo de Desenvolvimento Sustent\u00e1vel n\u00ba 5 da Agenda 2030 da Organiza\u00e7\u00e3o das Na\u00e7\u00f5es Unidas (ONU), que visa alcan\u00e7ar a\u00a0igualdade\u00a0de\u00a0g\u00eanero\u00a0e\u00a0empoderar\u00a0todas\u00a0as\u00a0mulheres e\u00a0meninas.<\/p>\n\n\n\n
