O Supremo Tribunal Federal (STF) adiou para junho, em data ainda a ser definida, o julgamento sobre a responsabilidade das redes sociais por conte\u00fados ilegais<\/a> publicados em suas plataformas. O tema estava pautado para esta quarta-feira, 17, no plen\u00e1rio, mas teve a an\u00e1lise adiada a pedido dos relatores, os ministros Dias Toffoli e Luiz Fux. A caso estava para julgamento em meio ao impasse no Congresso a respeito do chamado Projeto de Lei das Fake News, cuja vota\u00e7\u00e3o foi adiada na C\u00e2mara ap\u00f3s forte campanha de empresas de tecnologia contr\u00e1rias ao projeto, que na v\u00e9spera da an\u00e1lise pelos parlamentares disseminaram cr\u00edticas ao PL. Al\u00e9m das consequ\u00eancias pol\u00edticas, plataformas como Google e Telegram s\u00e3o investigadas por suposto abuso de poder econ\u00f4mico no caso<\/a> . Uma investiga\u00e7\u00e3o foi aberta no Supremo, por ordem do ministro Alexandre de Moraes e a pedido da Procuradoria-Geral da Rep\u00fablica (PGR). O Conselho Administrativo Econ\u00f4mico (Cade), que fiscaliza o cumprimento de regras concorrenciais, tamb\u00e9m apura a conduta das empresas. Ainda n\u00e3o h\u00e1 data para que o tema volte ao plen\u00e1rio da C\u00e2mara, diante da d\u00favida se o PL das Fake News conseguir\u00e1 votos suficientes dos deputados para ser aprovado. No Supremo, a percep\u00e7\u00e3o dos ministros \u00e9 que o caso deve ser tratado preferencialmente pela via legislativa, mas que o tribunal dever\u00e1 agir para preencher eventual omiss\u00e3o do Congresso. Para isso, o Supremo dever\u00e1 julgar dois recursos com repercuss\u00e3o geral – cujo desfecho dever\u00e1 servir de par\u00e2metro para os demais casos semelhantes – que questionam o artigo 19 do Marco Civil da Internet. O dispositivo dispensa as plataformas de redes sociais de responsabiliza\u00e7\u00e3o caso n\u00e3o removam publica\u00e7\u00f5es de usu\u00e1rios que sejam flagrantemente il\u00edcitas. Desde os atos golpistas de 8 de janeiro, planejados e executados com aux\u00edlio de aplicativos de mensagens e redes sociais, diversos ministros do Supremo tem se posicionado publicamente em defesa da regula\u00e7\u00e3o dessas plataformas, de modo a conferir grau de responsabilidade \u00e0s empresas que as administram se elas n\u00e3o agirem para impedir a dissemina\u00e7\u00e3o de mensagens antidemocr\u00e1ticas. O tema tem peso diferenciado para o Supremo, cuja sede foi a mais depredada pelos v\u00e2ndalos que invadiram as sedes dos Tr\u00eas Poderes no 8 de janeiro. A maioria dos ministros da Corte est\u00e3o convencidos de que o epis\u00f3dio poderia ter sido evitado se o uso das redes sociais j\u00e1 tivesse sido melhor regulamentado no pa\u00eds. Desde a elei\u00e7\u00e3o presidencial de 2022, ministros como Alexandre de Moraes e Gilmar Mendes pressionam para que o Congresso aprove lei a respeito do assunto. Ap\u00f3s o 8 de janeiro, ministros como Rosa Weber, Edson Fachin e Luiz Fux tamb\u00e9m passaram a se manifestar mais abertamente nesse sentido. O julgamento sobre o Marco Civil da Internet foi tema de audi\u00eancia p\u00fablica no Supremo, em mar\u00e7o, quando ministros da Corte e do governo se revezaram na defesa de uma maior regulamenta\u00e7\u00e3o das redes sociais. Recentemente, a PGR tamb\u00e9m se manifestou, nos pr\u00f3prios recursos sobre o assunto, a favor de uma maior responsabiliza\u00e7\u00e3o das redes sociais que n\u00e3o removerem conte\u00fado ofensivo ap\u00f3s alertadas. A press\u00e3o por uma regulamenta\u00e7\u00e3o maior das redes sociais aumentou ainda mais na esteira de ataques e amea\u00e7as a escolas brasileiras que foram anunciados e estimulados em plataformas como o Twitter. As empresas se defendem afirmando que uma maior regula\u00e7\u00e3o deve desestimular investimentos para aprimorar as plataformas de redes sociais, bem como representa uma amea\u00e7a \u00e0 liberdade de express\u00e3o.<\/p>\n
