De acordo com senten\u00e7a da 2\u00aa Vara Federal de Chapec\u00f3, houve erro do INSS em n\u00e3o considerar que se mantinha a condi\u00e7\u00e3o de incapacidade para o trabalho, com manuten\u00e7\u00e3o da aposentadoria.<\/p>\n<p>\u201cNo caso dos autos restou suficientemente demonstrado que a suspens\u00e3o do benef\u00edcio previdenci\u00e1rio do autor ocorreu por equ\u00edvoco do INSS\u201d, afirmou o juiz Narciso Leandro Xavier Baez, em decis\u00e3o proferida ter\u00e7a-feira (6\/6). \u201cNa per\u00edcia realizada junto ao feito judicial o perito referiu que o autor possui incapacidade multiprofissional e que n\u00e3o possui condi\u00e7\u00f5es de reabilita\u00e7\u00e3o profissional\u201d, observou.<\/p>\n<h3>Entre no  <a href=\"https:\/\/t.me\/iGBrasilEconomico\" target=\"_blank\" rel=\"noopener nofollow\" data-mce-href=\"https:\/\/t.me\/iGBrasilEconomico\">canal do Brasil Econ\u00f4mico no Telegram<\/a> e fique por dentro de todas as not\u00edcias do dia. Segundo o processo, no \u00e2mbito administrativo a per\u00edcia verificou que o interessado tinha dificuldades, mas que n\u00e3o havia exames ou registros m\u00e9dicos recentes.<\/p>\n<p>\u201cO INSS n\u00e3o pleiteou que autor atualizasse seus exames antes de concluir pela incapacidade laborativa, nem tampouco levou em considera\u00e7\u00e3o as condi\u00e7\u00f5es pessoais do autor e o longo tempo de benef\u00edcio alimentar, cujo cancelamento traria preju\u00edzos incont\u00e1veis ao autor\u201d, considerou Baez.
