O Minist\u00e9rio P\u00fablico Federal (MPF) e o Minist\u00e9rio P\u00fablico do Estado de S\u00e3o Paulo (MP\/SP) entraram com uma a\u00e7\u00e3o civil p\u00fablica<\/strong> na Justi\u00e7a Federal contra o prefeito do munic\u00edpio de Ilhabela, litoral norte de S\u00e3o Paulo, Antonio Luiz Colucci<\/strong> , para o pagamento de uma compensa\u00e7\u00e3o de R$ 2 milh\u00f5es por danos morais coletivos.<\/p>\n

As acusa\u00e7\u00f5es giram em torno de incita\u00e7\u00e3o feito pelo prefeito \u00e0 pr\u00e1tica de crimes ambientais e danos ao meio ambiente durante uma audi\u00eancia p\u00fablica. <\/p>\n

Durante o evento, Colucci encorajou os participantes a retirar ilegalmente partes da vegeta\u00e7\u00e3o de “jundu” presente nas praias do munic\u00edpio. Jundu \u00e9 uma vegeta\u00e7\u00e3o protegida como \u00e1rea de preserva\u00e7\u00e3o permanente da regi\u00e3o.<\/p>\n

A audi\u00eancia p\u00fablica ocorreu em 27 de abril de 2023, na Escola Municipal Prefeito Leonardo Real, localizada no Bairro Arma\u00e7\u00e3o, em Ilhabela. No audi\u00eancia, o prefeito iniciou uma discuss\u00e3o com um dos presentes sobre a retirada de uma suposta planta\u00e7\u00e3o de jundu e, em um determinado momento, mesmo reconhecendo que tal a\u00e7\u00e3o constitui um crime, explicitamente incita a popula\u00e7\u00e3o a realizar a retirada clandestina.<\/p>\n

“Vamos acabar com o jundu, voc\u00eas precisam me ajudar. Eu n\u00e3o posso mandar a prefeitura fazer isso, sen\u00e3o eu vou para a cadeia. Mas se cada um de voc\u00eas arrancar um p\u00e9 por dia, rapidamente n\u00e3o haver\u00e1 mais nenhum. V\u00e3o l\u00e1, cada um vai l\u00e1 e… puxa o pezinho, puxa o p\u00e9”<\/em> , disse o prefeito ao participantes.<\/p>\n

A a\u00e7\u00e3o assinada pela procuradora da Rep\u00fablica Maria Rezende Capucci e pelos promotores de Justi\u00e7a Alfredo Luis Portes Neto e Tadeu Ivahy Badar\u00f3 J\u00fanior, registra que as palavras do prefeito n\u00e3o podem ser consideradas como um exerc\u00edcio leg\u00edtimo do direito \u00e0 liberdade de express\u00e3o. <\/p>\n

Para eles, o que o prefeito disse \u00e9 considerado uma incita\u00e7\u00e3o delibera\u00e7\u00e3o \u00e0 pr\u00e1tica de atividades ambientais il\u00edcitas, o que contraria os direitos fundamentais assegurados pela Constitui\u00e7\u00e3o Federal, bem como os princ\u00edpios de legalidade e moralidade administrativas.<\/p>\n

Al\u00e9m da a\u00e7\u00e3o civil p\u00fablica, o Minist\u00e9rio P\u00fablico Estadual solicitou a abertura de um inqu\u00e9rito policial<\/strong> contra o prefeito de Ilhabela para investigar se ele incitou os moradores a cometerem crimes ambientais e se cometeu crime de responsabilidade. <\/p>\n

A incita\u00e7\u00e3o ao crime \u00e9 considerada uma conduta criminosa de acordo com o C\u00f3digo Penal, podendo resultar em deten\u00e7\u00e3o de 3 a 6 meses ou multa. O portal iG<\/a> entrou em contato com a prefeitura de Ilhabela, mas at\u00e9 o momento n\u00e3o obteve retorno. <\/p>\n
