O Supremo Tribunal Federal (STF) pode formar hoje (21) maioria de votos contra a tese do Marco Temporal para demarca\u00e7\u00e3o de terras ind\u00edgenas.<\/a> Com placar de 5 votos a 2,<\/a> a sess\u00e3o ser\u00e1 retomada \u00e0s 14h, quando a Corte entrar\u00e1 na 11\u00aa sess\u00e3o para analisar a quest\u00e3o.<\/p>\n

No julgamento, os ministros discutem o chamado Marco Temporal. Pela tese, defendida por propriet\u00e1rios de terras, os ind\u00edgenas<\/strong> somente teriam direito \u00e0s \u00e1reas que estavam em sua posse no dia 5 de outubro de 1988,<\/a> data da promulga\u00e7\u00e3o da Constitui\u00e7\u00e3o Federal, ou que estavam em disputa judicial na \u00e9poca. Os ind\u00edgenas<\/strong> s\u00e3o contra o entendimento.<\/p>\n

At\u00e9 o momento, os ministros Alexandre de Moraes, Lu\u00eds Roberto Barroso,<\/a> Edson Fachin, Cristiano Zanin<\/a> e Dias Toffoli <\/a> se manifestaram contra o Marco Temporal e entendem que a limita\u00e7\u00e3o \u00e9 inconstitucional. Nunes Marques e Andr\u00e9 Mendon\u00e7a<\/a> se manifestaram a favor.<\/p>\n

Faltam os votos dos ministros Luiz Fux, C\u00e1rmen L\u00facia, Gilmar Mendes e da presidente, Rosa Weber.<\/p>\n

Alcance<\/h2>\n

Apesar da posi\u00e7\u00e3o que deve ser consolidada contra a tese, os ministros ainda v\u00e3o decidir sobre o alcance da decis\u00e3o.<\/p>\n

Entre os votos<\/strong> proferidos, est\u00e1 a possibilidade de indeniza\u00e7\u00e3o de particulares que adquiriram terras de \u201cboa-f\u00e9\u201d. Pelo entendimento, a indeniza\u00e7\u00e3o por benfeitorias e pela terra<\/strong> nua valeria para propriet\u00e1rios que receberam do governo t\u00edtulos de terras que deveriam ser consideradas como \u00e1reas ind\u00edgenas.<\/p>\n

Em outro ponto, o ministro Dias Toffoli abriu a possibilidade de explora\u00e7\u00e3o mineral e de lavouras dentro das terras ind\u00edgenas,<\/a> mediante aprova\u00e7\u00e3o de uma lei pelo Congresso e a autoriza\u00e7\u00e3o dos ind\u00edgenas.<\/p>\n

Os dois pontos s\u00e3o questionados pelas entidades que atuam em defesa dos ind\u00edgenas. Para a Articula\u00e7\u00e3o dos Povos Ind\u00edgenas do Brasil (Apib), a possibilidade de indeniza\u00e7\u00e3o<\/strong> pode inviabilizar as demarca\u00e7\u00f5es. A entidade tamb\u00e9m argumenta que a explora\u00e7\u00e3o econ\u00f4mica flexibiliza o usufruto exclusivo das terras pelos ind\u00edgenas.<\/p>\n

Para acompanhar o julgamento no STF, ind\u00edgenas<\/strong> est\u00e3o mobilizados em Bras\u00edlia. Eles tamb\u00e9m se manifestam contra a tentativa do Senado de legalizar o Marco Temporal.<\/p>\n
