Kenneth Eugene Smith experimentou o caminho em dire\u00e7\u00e3o \u00e0 morte duas vezes. Sentenciado ap\u00f3s o assassinato de uma mulher, Elizabeth Sennett, em 1988, Smith deveria ter recebido uma inje\u00e7\u00e3o letal em novembro de 2022 para cumprir sua pena de morte. A a\u00e7\u00e3o, contudo, foi adiada ap\u00f3s falhas de execu\u00e7\u00e3o.<\/p>\n

Na noite dessa quinta-feira (25), Kenneth Smith cumpriu a pena: ele foi morto atrav\u00e9s de um novo e controverso m\u00e9todo de execu\u00e7\u00e3o por asfixia de nitrog\u00eanio,<\/a> considerado “cruel, desumano e degradante” pela Organiza\u00e7\u00e3o das Na\u00e7\u00f5es Unidas (ONU).<\/p>\n

A hip\u00f3xia por nitrog\u00eanio foi usada pela primeira vez no mundo em Smith, segundo o Centro de Informa\u00e7\u00f5es sobre Pena de Morte, ap\u00f3s a equipe de defesa do r\u00e9u interromper o processo com v\u00e1rios recursos judiciais.<\/p>\n

A \u00faltima tentativa da defesa ocorreu na quarta-feira (24), quando se tentou contra a legalidade do protocolo de execu\u00e7\u00e3o com g\u00e1s nitrog\u00eanio estabelecido pelo estado do Alabama. Os pedidos da defesa foram negados pela Justi\u00e7a dos Estados Unidos. <\/p>\n

Kenneth estava no corredor da morte desde 1989, ap\u00f3s ter sido condenado pela morte de Elizabeth Sennett, que foi esfaqueada e espancada. O assassinato foi encomendado pelo marido da mulher, um pastor que se matou posteriormente.<\/p>\n

No tribunal, Kenneth admitiu estar presente no momento do ato, mas afirmou n\u00e3o ter participado diretamente do crime. O j\u00fari o considerou culpado por quase unanimidade (11 votos a 1), e recomendou pris\u00e3o perp\u00e9tua com possibilidade de liberdade condicional. O juiz do caso, por\u00e9m, o condenou \u00e0 morte, pena legalizada no estado do Alabama, onde ocorreu o caso.<\/p>\n

Por que a ONU considera o m\u00e9todo tortura?<\/h3>\n

Esse m\u00e9todo de execu\u00e7\u00e3o funciona ao substituir o oxig\u00eanio do corpo por meio da respira\u00e7\u00e3o de nitrog\u00eanio puro. A pr\u00e1tica gerou preocupa\u00e7\u00f5es internacionais, especialmente da ONU, que expressou comunicados por meio do Gabinete de Direitos Humanos. <\/p>\n

A organiza\u00e7\u00e3o pediu a suspens\u00e3o da execu\u00e7\u00e3o,<\/a> alegando que o m\u00e9todo poderia constituir tortura, violando tratados internacionais de direitos humanos assinados pelos Estados Unidos.<\/p>\n

A ONU argumentou que, com base em evid\u00eancias periciais, essa forma de execu\u00e7\u00e3o pode causar dor e sofrimento ao condenado. Al\u00e9m disso, a falta de inclus\u00e3o de um sedativo no protocolo do Alabama foi criticada pela organiza\u00e7\u00e3o, que destacou a recomenda\u00e7\u00e3o at\u00e9 mesmo na execu\u00e7\u00e3o de animais, segundo a Associa\u00e7\u00e3o M\u00e9dica Veterin\u00e1ria Americana.<\/p>\n

De acordo com o Gabinete de Direitos Humanos, h\u00e1 aus\u00eancia de evid\u00eancia cient\u00edfica que sustente a execu\u00e7\u00e3o por hip\u00f3xia de nitrog\u00eanio, sob o argumento de que existem possibilidades do condenado sofrer com convuls\u00f5es violentas ou ainda sobreviver em estado vegetativo. <\/p>\n

Assim como o Alabama, outros estados dos EUA onde a pena de morte \u00e9 legalizada \u2013 como Oklahoma e Mississippi \u2013 t\u00eam considerado a execu\u00e7\u00e3o por meio de pr\u00e1ticas alternativas, devido \u00e0 escassez de drogas utilizadas nas inje\u00e7\u00f5es letais. Essa tend\u00eancia contribuiu para a queda do uso da pena de morte em todo o pa\u00eds desde 2018.<\/p>\n
