A Ag\u00eancia Nacional de Energia El\u00e9trica (Aneel) aplicou uma multa de R$ 165,8 milh\u00f5es \u00e0 Enel pelo apag\u00e3o que atingiu a Regi\u00e3o Metropolitana de S\u00e3o Paulo em novembro do ano passado. Na ocasi\u00e3o, cerca de 2,1 milh\u00f5es de pessoas ficaram sem luz, com o fornecimento levando uma semana para ser normalizado.<\/p>\n

Segundo o auto de infra\u00e7\u00e3o, que se tornou p\u00fablico nesta sexta-feira (9), a Enel S\u00e3o Paulo n\u00e3o prestou servi\u00e7os de forma adequada. A companhia s\u00f3 acionou significativamente as equipes de manuten\u00e7\u00e3o \u2013 pr\u00f3prias e terceirizadas \u2013 em 6 de novembro, tr\u00eas dias ap\u00f3s o temporal que derrubou \u00e1rvores e comprometeu o abastecimento de energia em diversas \u00e1reas da capital paulista e dos arredores.<\/p>\n

De acordo com a Aneel, a concession\u00e1ria de energia descumpriu uma resolu\u00e7\u00e3o normativa que permite a penaliza\u00e7\u00e3o de companhias por \u201cimplantar, operar ou manter instala\u00e7\u00f5es de energia el\u00e9trica e os respectivos equipamentos de forma inadequada\u201d. A ag\u00eancia reguladora tamb\u00e9m informou que a Enel descumpriu o contrato ao n\u00e3o garantir o fornecimento de energia \u00e0 popula\u00e7\u00e3o afetada pela tempestade.<\/p>\n

O documento da Aneel apontou ainda que a energia s\u00f3 foi restabelecida em todos os im\u00f3veis afetados apenas em 10 de novembro, uma semana ap\u00f3s o temporal. Segundo o auto de infra\u00e7\u00e3o, mesmo que tenha ocorrido um evento clim\u00e1tico severo, a distribuidora deve adotar procedimentos de opera\u00e7\u00e3o e de manuten\u00e7\u00e3o que levem \u00e0 normaliza\u00e7\u00e3o \u201cc\u00e9lere\u201d do sistema.<\/p>\n

Segundo a ag\u00eancia reguladora, embora a Enel S\u00e3o Paulo obede\u00e7a aos limites regulat\u00f3rios de dura\u00e7\u00e3o e de frequ\u00eancia de interrup\u00e7\u00f5es no fornecimento de energia, os indicadores pioraram nos \u00faltimos anos, principalmente em ocorr\u00eancias emergenciais.<\/p>\n

A Enel ainda pode recorrer da multa. Um eventual recurso ser\u00e1 primeiramente analisado pela \u00e1rea t\u00e9cnica da Aneel. Em seguida, ser\u00e1 encaminhado para a diretoria da ag\u00eancia, que decidir\u00e1 se acolhe os argumentos da distribuidora.<\/p>\n
